INTELLECTUAL PROPERTY SOLICITORS

INTELLECTUAL PROPERTY RIGHT PROTECTION

Businesses invest vast sums into developing their intellectual property. It might be a brand that is instantly recognizable or a revolutionary piece of technology. It is vitally important to protect those rights to prevent infringement and illegal use. Trademarks, patents, registered designs, copyright, the law of passing off, are all forms of intellectual property right protection.

Some rights arise automatically but others need to be registered at the appropriate Intellectual Property Office. Failure to register them may mean that you have no right to stop a competitor from using your rights without your consent. We would therefore recommend that you speak to us today about protecting your intellectual property rights.

Businesses are normally recognized by their brand. Brands can take many different forms. It may be the name of the business or a particular product or the stylised form or typographic representation of the name, a graphic device or logo.

Trademarks can protect many different forms of branding, whether business and product names, logos, shapes, sounds and even smells. After identifying the brand that you want to protect the next stage will be to identify where you need to protect your trademark. This could be in the UK but could also be throughout Europe or even globally. If you do not register your branding as a trademark in the relevant jurisdiction then it may be open to misuse by others. To be capable of protection, all elements of a brand or logo must be distinctive and unique to the company (the owner) and must distinguish it from similar goods and/or services produced by the competition.

We can assist with the entire process. We will conduct searches of registered trademarks to determine whether a conflict exists. If no conflict exists we can process your application and register your new trade mark. If a conflict exists we can advise you of your options.

A patent needs to be registered. Once registered it will give the owner the right to stop anyone else from making, using, or selling their invention without their permission. Patent applications can be very complex and must be filed with the relevant patent office or intellectual property office. Successful patent applications last for 20 years from the filing of the application. Like many areas of intellectual property, patents are only valid in certain territories and so a patent registered in the UK, is only valid in the UK.

Copyright protects ideas or creative activity that has been fixed or recorded in some way. This might include for instance, written text, software codes, drawings, photographs, sculptures, works of architecture and works of artistic craftmanship, films, broadcasts, theatrical plays, music, and songs.

In the UK and Europe, design law protects the shape or outward appearance of a product. A basic form of unregistered protection arises automatically but designers can obtain a stronger form of protection by registering and protecting their designs. In order to protect a design it must be an original and new product, whose shape is not determined by its function or the need to fit or match other products.

At Birch Law we can assist with the protection of your intellectual property rights. We can carry out necessary checks to ensure that no conflict exists, we can advise on the correct method of protection and deal with the application process for you.
