TERMINATING AN EMPLOYMENT CONTRACT

MISCONDUCT IN THE WORK PLACE

If you have an employee that has behaved inappropriately you may be able terminate their employment as a result. An employee’s misconduct would include breaches of their employment contract or the company’s policies and procedures. It may also include instances where the employee brings the business into disrepute. Gross misconduct is something that is so serious that it justifies bringing the employment relationship to an immediate end.

If you are looking to terminate an employee’s employment contract because of misconduct you must follow a proper disciplinary process. Failure to do so may result in the employee bringing a claim for unfair dismissal. In short you must:

  • Follow any disciplinary policies and procedures you have in place.
  • Investigate the alleged misconduct and establish the facts of the case.
  • If appropriate, suspend the employee whilst those investigations are ongoing.
  • Inform the employee of the misconduct and invite the employee into a meeting.
  • Decide on an appropriate course of action.
  • Provide the employee with an opportunity to appeal.

If one of your employees has behaved in a way that has led you to want to end their employment you should contact our employment team as early as possible. We can advise you on whether we think the behavior amounts to gross misconduct or whether you would have grounds to otherwise terminate the employee’s employment contract.
