SETTLEMENT AGREEMENTS

Settlement agreements are agreements made between an employer and an employee which amicably end a contract of employment or settle a dispute. For the settlement agreement to be binding the employee must obtain legal advice and the legal advisor must sign a certificate confirming that the employee has been advised on the legal ramifications of accepting the settlement agreement.

We offer a fixed fee advice service in connection with settlement agreements. We will provide you with advice on the settlement agreement; make any necessary amendments; liaise with you and your employer; and ensure that your legal rights are always protected for a one-off price.

In most cases your employer will cover your legal fees. At the outset we will provide you with a fixed fee for our services to ensure certainty of costs. We also offer a quick and flexible service to suit your needs and any specific time frames.

A settlement agreement is a legally binding contract used to prevent employees from bringing certain legal claims against the employer in the future, and usually involves a sum of money being paid to the employee in return.

Settlement agreements can be offered in a range of scenarios but are mostly used by employers to terminate an employment contract on a mutually agreed basis. You might also be asked to sign a settlement agreement to bring an ongoing employment dispute to an end.

The settlement agreement is a legally binding agreement. It provides both security and certainty. Your employer has the guarantee that you won’t make a claim against them in the future, and you will be reassured of the financial settlement aspect of your termination as well as any future job reference.

Settlement agreements are completely voluntary. You must be given a reasonable period to consider the conditions of the proposed agreement. If you are still unhappy with the terms of the agreement, after considering it with an employment lawyer, you are under no obligation to agree to it.

It is common for the employer to offer to pay a contribution towards the legal costs incurred by the employee (although this isn’t a legal requirement). This contribution normally ranges from a minimum of £250 to a maximum £1,000 and may or may not include the VAT element.

Whichever funding route you choose, you can rest assure that our experienced solicitors will always do their utmost to keep costs as low as possible.
