Common examples of claims against surveyors include:

1. When carrying out a valuation.

  • Where a surveyor is instructed to undertake a valuation of a property the law states that if the Surveyor mis-values the property (outside of a reasonable margin) then the Surveyor will have breached their duty to the client.
  • With regards valuations, professional negligence claims against Surveyors often arise where their valuation falls outside of the accepted bracket of possible valuations for that property.
  • The client will then, in most circumstances, look to recover the difference between the negligent valuation and the actual valuation.

 

2. When carrying out a survey or inspection.

  • With regards to surveys and inspections the extent of the surveyor’s duty of care depends upon the type of survey being undertaken. There are three main types: a mortgage valuation report; a homebuyer report and a building survey.
  • If a client simply selects a mortgage valuation report the duty owed is limited and includes just a basic inspection. However, if a client selects a building survey the duty owed is much greater and the surveyor will be expected to go into far more detail about the condition of the property.
  • Where a surveyor has been instructed to undertake a home buyer report and, in undertaking that inspection, fails to spot and/or report on any defects that were obvious (or should have been obvious) then the surveyor will be negligent. In these sorts of cases the level of loss is the difference between the purchase price and the actual value of the property.
