Some common examples of building disputes include:

1. Poor workmanship, remedial work, and additional costs.

  • Unfortunately, you sometimes come across a builder whose work is simply substandard.
  • Whilst some snagging issues are common other defects can be expensive to put right. Poor building work, whether at home or at work, can also be very dangerous.
  • If you have had to instruct another builder to rectify substandard or defective work caused by your initial builder, then you may be entitled to damages to compensate you for your loss.

 

2. Non compliance with building regulations.

  • Building regulations are designed to ensure that work is carried out safely and professionally to a high standard complying with all relevant health and safety regulations.

  • We acted for a client in London who was having extensive renovation works to their Victorian property. They engaged with a builder to carry out works to their property and garden area. The builder failed in its responsibilities to our client causing substantial damage. The builder failed to carry out his responsibilities with due care and attention. In addition to internal defects the builder failed to reinforce trenches dug in the garden for foundations. This resulted in a land slide causing significant financial damage. We successfully recovered damages for our client from the builder’s professional indemnity insurers.

 

  • We acted for a property developer in south Manchester. They were renovating a large building into residential apartments. As part of the renovation, they contracted with a builder. That builder was contracted to take the building back to shell; construct the shell of the apartments; deal with all electrics and plumbing and also landscape the grounds. The builder failed to carry out his duties with reasonable skill and care and also failed to follow architectural drawings and plans. Our client had to terminate its contract with the builder and instruct an alternative to rectify the defects and complete the works. The client then instructed us to pursue the original builder for damages. We successfully recovered six figure damages for our client.
