The Government made squatting in a residential building a criminal offence under Section 144 of the Legal Aid, Sentencing and Punishment of Offenders Act 2012 (LAPOA). The police can remove squatters if the squatter:

  • Is in a residential building as a trespasser and entered as a trespasser.
  • Know, or ought to know, they are trespassing.
  • Is living in the building, or intends to live there, for any period of time.

However, squatters are also protected from threats and intimidation in the eviction process under The Protection From Eviction Act 1977. It is therefore vital that you take expert legal advice in any trespass case involving squatters to make sure they are not evicted unlawfully as a result of harassment or intimidation.

If travelers are trespassing on your land our expert trespass solicitors can apply to the court for a Possession Order. A Possession Order is an order from the court that compels the travelers to leave. If they don’t then we can enforce the Possession Order. To enforce a Possession Order we can apply to the High Court on your behalf for a Warrant of Possession (also known as a Writ of Possession). Using this process, a certified High Court Bailiff will then evict the travelers for you.
