Adjudication is the process by which a third party adjudicator will make a determination of the issues in dispute. It is a far simpler, quicker, and cheaper method of resolving a dispute than formal court proceedings. However, for all its benefits, there are certain drawbacks. One of these is that once started – documents, expert input, and witness evidence are all required within a few days. If you receive notice of adjudication, it is important to act quickly. You must not ignore it and must act immediately as the adjudicator will often make a determination within 28 days of the referral notice (subject to any extensions of time).

The decision is legally binding unless and until it is overturned through litigation or arbitration. It is important to note that the responding party must pay or act upon the adjudicator’s decision before challenging it. Essentially you must pay even though you dispute the adjudicator decision and then later seek to have the decision overturned. This can pose issues if the responding party pays money to a contractor that is later unable to repay the money.
