If a tenant does something which is specifically prohibited in the lease, such as subletting without permission or carrying out unauthorised alterations, then this would amount to a breach of covenant. Failure to comply with these covenants may result in action being taken including claims for both damages and forfeiture.

If a tenant fails to pay the rent as and when it falls due this would amount to a breach of covenant. In such cases a landlord may forfeit the lease and/ or pursue the tenant for damages to account for the rent arrears.

In commercial leases there is commonly a clause allowing peaceable re-entry to take possession following rent arrears. This action can only be taken in respect of commercial tenants. There are procedures to follow if using this method, and it is important to get these steps right.
