Any employment dispute should follow a set process. The employee would begin by sending a letter of complaint to the employer setting out the reasons for their claim. Next the employee should refer the matter to the Advisory, Conciliation and Arbitration Service (ACAS). ACAS is an independent service designed to promote early settlement of employment disputes. Should that fail the employee will need to refer the matter to the employment tribunal.

Usually, the employee will have to make a claim to tribunal within three months of the problem occurring, or he/she (the employee) will be out of time to bring a claim.
