Another alternative to court proceedings would be for the parties to engage in mediation. Mediation is a confidential and non-binding process whereby the parties agree to instruct an independent third party to mediate their dispute or facilitate resolution. The process is informal and importantly always kept confidential. If successful, the parties will then need to enter into a settlement agreement to ensure that the terms are binding. If unsuccessful, the parties are free to continue with their dispute if they so wish.
